ImaScents – Terms & Conditions
1. Introduction
This website and/or online platform (including WhatsApp and social media platforms) is operated by ImaScents, a fragrance store based in Nkomazi, Mpumalanga, South Africa (“ImaScents”, “we”, “us”, or “our”).
These Terms and Conditions govern:
the use of our website and online platforms; the ordering, sale, and delivery of products (“Goods”); all transactions between ImaScents and its customers.
By accessing or using our website, placing an order, or communicating with us electronically, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
2. Application of the Consumer Protection Act
These Terms and Conditions apply to consumers as defined in the Consumer Protection Act, 68 of 2008 (“CPA”).
Nothing in these Terms and Conditions is intended to limit or exclude any rights you may have under the CPA.
3. Important Notice
Certain provisions in these Terms and Conditions:
limit or exclude ImaScents’ liability; create obligations for the customer; require the customer to indemnify ImaScents.
If you do not understand any provision, please contact us for clarification before placing an order.
4. Products
ImaScents sells fragrances and related products (“Goods”).
All product images are for illustration purposes only. Packaging, bottle design, or colour may differ slightly from images shown.
5. Registration and Use
Only registered users may place orders through our website (where applicable).
You must provide accurate and complete information when registering or placing an order.
You are responsible for maintaining the confidentiality of your login details.
Any activity conducted using your account is deemed to be authorised by you.
You must be 18 years or older or have parental/guardian consent to place an order.
6. Prohibited Use
You may not:
misuse the website or interfere with its functionality;
use automated systems to extract data;
distribute unlawful, offensive, defamatory, or harmful content;
copy or reproduce website content without written permission.
7. Orders, Sales & Stock Availability
All orders are subject to acceptance by ImaScents.
Acceptance occurs only once payment is received and the Goods are dispatched or made available for collection.
Stock is limited and availability is not guaranteed.
Prices may change without notice.
If an item becomes unavailable after payment, you will be notified and refunded in full.
Placing items in a cart or enquiring via WhatsApp does not constitute a confirmed order.
8. Cancellation & Returns
Orders may be cancelled before dispatch.
After dispatch or collection, returns are governed by our Returns Policy, in line with the CPA.
For hygiene and safety reasons, opened or used fragrances may not be returned, unless defective.
9. Payment
All payments are processed securely.
Accepted payment methods include:
- Debit cards
- Credit cards
- Instant EFT
- Direct bank deposit / EFT
Other methods communicated by ImaScents from time to time
For EFT or bank deposits:
Payment must be made within 5 (five) days of placing the order.
Orders will not be processed until payment is received and cleared.
You warrant that you are authorised to use the payment method selected.
10. Delivery & Collection
ImaScents offers:
Courier delivery, or
Self-collection (by arrangement)
Delivery will take place within 5-7 days of payment, unless otherwise agreed.
Risk passes to you once the Goods are delivered to the address you provided or collected by you.
ImaScents is not responsible for loss or damage after delivery.
11. Errors & Pricing
We take reasonable steps to ensure accuracy; however:
pricing or description errors may occur;
ImaScents reserves the right to cancel orders affected by errors;
if payment was made, a full refund will be issued.
ImaScents is not bound by information displayed on third-party websites.
12. Gift Vouchers & Promotions
Gift vouchers are valid for 3 years from date of issue unless stated otherwise.
Vouchers are not refundable or redeemable for cash.
Lost or misused vouchers are not the responsibility of ImaScents.
Promotions are subject to specific terms and may be limited in quantity or duration.
13. Intellectual Property
All content on our website and platforms—including logos, images, text, designs, and branding—is the intellectual property of ImaScents or its licensors.
Unauthorised use, copying, or distribution is prohibited.
14. Disclaimer
Use of the website and services is at your own risk.
While we strive for accuracy, ImaScents makes no warranties regarding:
uninterrupted access;
accuracy of information;
suitability of products for a specific purpose.
All Goods are provided “as is”, subject only to statutory warranties under South African law.
15. Limitation of Liability
To the extent permitted by law:
ImaScents is not liable for indirect, incidental, or consequential damages;
liability is limited to the value of the Goods purchased;
nothing excludes liability for gross negligence or wilful misconduct.
You indemnify ImaScents against claims arising from misuse of the website or breach of these Terms.

Links to third-party websites are provided for convenience only. ImaScents is not responsible for their content, practices, or privacy policies.
17. Availability & Termination
We may suspend or terminate access to the website at any time for maintenance, security, or misuse.
Fraudulent activity may result in order cancellation, account suspension, or blacklisting.
18. Changes to Terms
ImaScents may update these Terms and Conditions at any time.
Continued use after updates constitutes acceptance of the revised Terms.
19. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
You consent to the jurisdiction of South African courts, without limiting your rights under the CPA.

22. General
